From 1 January 2011, rail carriers are obliged to have a Safety Certificate issued by the Chairman of the Railway Transportation Authority. It is one of the conditions to obtain access to the rail infrastructure. The document confirms the implementation by the rail carrier of the Safety Management System, and guarantees that the carrier meets the safety requirements stipulated by the provisions of the European Union and national law.
The Safety Certificate is composed of two parts. Part "A" accepts the Safety Management System adopted in the Company, prepared in accordance with the requirements of the European Union. Part "B" is a document entitling for the provision of services of passenger transportation in Poland. Based on the decision of the Chairman of the Railway Transportation Authority TT-0211-C-35/2010, on 3 December 2010, the document "Szybka Kolej Miejska Sp. z o.o. Safety Management System" was accepted. Part "A" of the Safety Certificate was issued on 10 December 2015, and part "B" on 20 December 2015. Certificate is issued based on the act on railway transport (Journal of Laws of 2007 No. 16, item 94 with further amendments) and remains valid for five years.
